A new bill authored by State Sen. Dan Feyen in the Wisconsin Senate seeks to amend statutes governing residential rental agreements to clarify tenant rights and remedies related to voidable lease provisions, according to the Wisconsin State Senate.

According to the Wisconsin State Legislature's official website, the bill was described as follows: "voidable provisions in residential rental agreements and the application of the Wisconsin Consumer Act to leases. (FE)".

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, the bill amends current Wisconsin statutes related to voidable provisions in residential rental agreements. It allows tenants to either void the lease or remove the voidable provisions if a court identifies them. In such cases, tenants may opt to convert their lease into a periodic tenancy while maintaining similar terms minus the objectionable provisions. The bill specifies that under certain conditions, tenants can recover twice the pecuniary losses caused by such provisions, excluding rent already paid. Additionally, the bill excludes residential and mobile home leases from the Wisconsin Consumer Act's scope, addressing recent legal interpretations concerning landlords as debt collectors. Effective after this enactment, these modifications limit tenant remedies to those explicitly outlined in the bill for rental agreements with voidable elements.

The bill was co-authored by Representative Scott Krug (Republican-72nd District), Senator John Jagler (Republican-13th District), Senator Steve L. Nass (Republican-11th District), Senator Romaine Robert Quinn (Republican-25th District), Senator Rob Stafsholt (Republican-10th District). It was co-sponsored by Representative Scott Allen (Republican-82nd District), Representative David Armstrong (Republican-67th District), and Representative Elijah R. Behnke (Republican-6th District), along 16 other co-sponsors.

Dan Feyen has authored or co-authored another 60 bills since the beginning of the 2025 session, with none of them being enacted.

Feyen graduated from Fox Valley Technical College in 1988.

Feyen, a Republican, was elected to the Wisconsin State Senate in 2025 to represent the state's 20th Senate district, replacing previous state senator Duey Stroebel.

In Wisconsin, the legislative process starts when a senator, constituent, group, or agency proposes an idea for a bill. After drafting, the bill is introduced, numbered, and referred to a committee for review and public input. If approved, it moves through three readings and votes in both the Senate and Assembly. Once both chambers pass the same version, the bill goes to the governor, who can sign it, veto it, or let it become law without a signature. Only a small share of bills introduced each session ultimately become law. You can learn more about the Wisconsin legislative process here.
